The tenets of the Council should not be touched ; KHADC decides to oppose extension of the CrPC and CPC: CEM KHADC

SHILLONG, August 01: The Khasi Hills Autonomous District Council (KHADC) has decided to oppose the plan of the Government to implement Civil Procedure Code(CPC) and the Criminal Procedure Code(CrPC) in the whole State.

The Chief Executive Member of the KHADC, Titosstarwell Chyne today called a meeting of all the MDCs in which were also present lawyers and judges of the District Council Court, and in this meeting, a decision was taken to oppose this aim of the Government.

The CEM said that if the CPC and CrPC is implemented or extended, without fail the courts of the District Council will lose their decision making power, and in this meeting a clarification was also given on what will happen if CrPC and CPC are put into effect.

He said that last Friday, the Government through the Commissioner Secretary of the DCA and in the meeting of the Government decided to examine this notification again in detail and to prepare a draft notification which would be sent to the Council for their expression on this aim to extend CrPC and CPC.

Chyne informed that the MDCs expressed grave concern over this matter which affects the powers and tenets of the Council, and in a unanimous voice decided that they will express to the Government that the notification of the Government should not affect the powers of the District Council.

On the other hand the CEM said that the KHADC has also expressed its opposition to the Indian Limitation Act because it will adversely affect the landownership right in the country, because if this Act is implemented, a person who has been a tenant for more than 12 years can claim the ownership of the said place taken on rent.
